Terms of Use

These Terms of Use ("Terms") govern your use of the Bufft: Expense Tracker application and related services (the "Service"). By using the Service, you agree to these Terms.

1. Eligibility and Your Responsibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use Bufft. You are solely responsible for the accuracy of the financial data you choose to enter into the app.

2. Service Description

Bufft is an expense tracking application that lets you manually record transactions, income, and budgets, and optionally interact with an AI Financial Advisor feature that provides general, automated information based on the data you provide. Bufft does not link to or access your bank or card accounts directly.

3. Accounts

You may need to create an account to use certain features of the Service, such as syncing your data across devices. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

4. AI Financial Advisor Disclaimer

Bufft offers an optional feature (the "AI Financial Advisor") that uses artificial intelligence, including third-party large language model technology, to generate general, automated responses based on information you provide.

4.1 Not Financial, Investment, Tax, or Legal Advice

The AI Financial Advisor is provided for general informational and educational purposes only. It does not constitute financial, investment, tax, accounting, legal, or other professional advice, and should not be relied upon as such. Nothing generated by the AI Financial Advisor is a recommendation to buy, sell, hold, or otherwise transact in any financial product, security, or instrument.

4.2 No Advisory or Fiduciary Relationship

Bufft is not a registered investment adviser, broker-dealer, financial planner, accountant, attorney, or fiduciary. Your use of the AI Financial Advisor does not create an advisory, fiduciary, professional, or client relationship between you and Bufft.

4.3 Automated, Unverified Output

Responses generated by the AI Financial Advisor are produced automatically using artificial intelligence and are not reviewed, verified, or endorsed by a human professional before being shown to you. AI-generated content may be inaccurate, incomplete, outdated, or otherwise unsuitable for your specific circumstances.

4.4 Your Responsibility

You are solely responsible for any decisions or actions you take based on information from the AI Financial Advisor. Before making any financial, investment, tax, or legal decision, you should independently verify the information and consult a qualified, licensed professional.

5. Subscriptions and In-App Purchases

Certain features of Bufft may be offered as paid subscriptions or in-app purchases through the Apple App Store or Google Play. If you purchase a subscription:

• It will auto-renew for the period and at the price shown at the time of purchase, unless canceled before the end of the current period.
• Billing and cancellation are managed through your Apple ID or Google Play account settings, in accordance with the applicable app store's policies.
• Any free trial offered will convert to a paid subscription at the end of the trial unless canceled beforehand.

6. Acceptable Use

• No unlawful, abusive, or fraudulent use of the Service.
• No attempts to interfere with the Service's security, AI features, or subscription/payment systems.
• No unauthorized copying, reverse engineering, resale, or exploitation of the Service.
• No submitting content to the AI Financial Advisor that is unlawful, harmful, or infringes on the rights of others.

7. Third-Party Services

The Service relies on third-party platforms and providers, including Apple, Google, cloud hosting providers, and AI/large language model providers. Your use of these third-party services may be subject to their own terms and privacy policies.

8. Intellectual Property

Bufft and its content, features, and functionality are owned by us or our licensors and are protected by intellectual property laws. You may not copy, modify, distribute, sell, lease, or reverse engineer any part of the Service without our prior written consent.

9. Disclaimers

The Service, including the AI Financial Advisor, is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement, to the maximum extent permitted by law.

10. Limitation of Liability

To the maximum extent permitted by law, Bufft will not be liable for any indirect, incidental, special, consequential, or punitive damages, including financial losses, arising from or related to your use of the Service or reliance on any information provided by the Service, including the AI Financial Advisor, even if we have been advised of the possibility of such damages.

11. Indemnification

You agree to indemnify and hold harmless Bufft and its officers, employees, and service providers from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or decisions made in reliance on information provided by the Service, including the AI Financial Advisor.

12. Changes to Terms

We may update these Terms from time to time. Updated Terms will be posted on this page with a revised effective date. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
